On July 15, 2025, the discussion about the nomination of Frauke Brosius-Gersdorf as constitutional judge is in full swing. The SPD candidate is facing severe accusations from the CDU/CSU, which led to the election in the Bundestag being suddenly canceled. Brosius-Gersdorf defends herself against attributions as “ultra-left” or “left-wing radical”, which she describes as “unrealistic and unobjective”. Her academic career at the University of Potsdam as a constitutional lawyer has been the focus of public reporting since her nomination. In an initial statement, she was critical of the reporting in general and disrespectful of anonymously made statements in the debate. According to Brosius-Gersdorf, their positions can clearly be assigned to the democratic center.

The pressure on the candidate became so great that the election of a total of three constitutional judges, which was originally on the Bundestag agenda, was canceled at short notice. The Union had particularly criticized its stance on abortion and the headscarf ban. Union faction leader Jens Spahn admitted that the concerns about Brosius-Gersdorf should have been treated more seriously. The Greens are now calling for a special session of the Bundestag in order to re-discuss the election as quickly as possible.

Frauke Brosius-Gersdorf has received support: around 300 legal scholars publicly support her and criticize the handling of her nomination. They complain that in the political debate not only factual arguments but also personal attacks were given importance. A special session could possibly be held this week, otherwise the election would be postponed until the next regular session in September.

Insight into the consequences of the removal

The failure of the election is not only seen as a breakdown in personnel selection, but also raises questions about the functionality of the Constitutional Court. Former constitutional judge Ferdinand Kirchhof emphasized that the court's independence was not at risk, even if the election was still a long time coming. However, there could be internal problems as judges have to make decisions in the same composition. Lengthy proceedings could be extended until the court is fully occupied, which may not be in the interest of justice.

Overall, the political situation remains tense. Brosius-Gersdorf hopes for a fair consideration of their positions and calls for the political discourse to be brought back to an objective level.
