A shocking case of negligent homicide is currently affecting the courts in Schwerin. The Schwerin regional court recently admitted charges against a 70-year-old and opened the main proceedings. He has to answer for negligent homicide and dangerous interference with road traffic. Surprisingly, the murder charge was rejected because there was no corresponding evidence, reports Nordkurier.

The accident occurred in February 2024 in a 30 km/h zone in the Lankow district, where the defendant lost control of his vehicle and accelerated to over 140 km/h. Tragically, a collision occurred with the rear of a vehicle driven by a 65-year-old woman, who died as a result of her injuries.

Background and legal classifications

The public prosecutor's office filed charges at the Schwerin district court and ultimately submitted the case to the regional court to examine jurisdiction. The taking of evidence should not deviate significantly from similar procedures and the importance of the case does not justify opening it before the regional court. The family of the deceased woman and the co-prosecution pushed for a murder charge. Their arguments were based on contradictions in the witness interviews and the behavior of the driver involved in the accident.

The case raises questions about the legal consequences of traffic accidents. According to Section 222 of the Criminal Code, negligent homicide is defined as the death of a person due to a breach of duty of care without intent. This can happen due to speeding or distracted driving. According to Erven Law Firm, between 660 and 800 cases of negligent homicide were recorded annually in Germany between 2014 and 2024, with 780 cases reported in 2024.
