At the moment, these rights are not expressly anchored in the Basic Law, which means that protection depends on the current political currents. Mayor Steffen Scheller agrees and emphasizes that the inclusion of child rights in the Basic Law sets a clear sign of taking into account the interests of children and adolescents. The initiative to anchor child rights in the Basic Law has a legal background. The Federal Ministry of Family Affairs has been committed to strengthening children's rights for years. The government parties' coalition agreement provides to include these rights into the Basic Law. In order to achieve this, however, a two-thirds majority in the Bundestag and the Federal Council is necessary, which gives the project an additional dimension.

why is that important

One of the key points is that despite their special need for protection, children are not explicitly mentioned in the constitutional text. The Federal Government recognized this, and the VN Convention on the Rights of Children, which has been in Germany since 1992, states that the child's well-being should be taken into account in state decisions. Nevertheless, reports on the implementation of this convention show that there is a need for improvement in various areas, especially in violence against children and the protection of minorities, according to the UN Children's Rights Committee, as well as Bündnis 90/The Greens reported.

The strengthening of children's rights should also support parents and families, at the same time strengthen the right to say for children and adolescents. In recent years, some progress has been made, such as the legal anchoring of the right to violence in 2000 and the introduction of "early help", which are funded annually with 51 million euros. The Gut-Kita law was also introduced to improve the quality in childcare.
