The Cottbus regional court has decided in a landmark ruling that the tenants must vacate their properties. The eviction lawsuits filed by the municipality of Märkische Heide were confirmed in all four proceedings. Around 50 tenants are affected, and the ruling has already caused various reactions among residents. In three cases it was found that the tenancies were legally terminated, while in another case an extension of the tenancy was refused.

The situation is not new, as the Lübben district court had already declared a corresponding eviction action against three tenants to be legal in December 2024. The municipality now wants to release the site for other uses, but there are still no concrete plans for what will happen there in the future. A sale was previously planned to an investor who wanted to build a holiday resort, but that buyer abandoned his plans.

Voluntary dismantling and deadlines

Mayor Dieter Freihoff (SPD) has made it clear that the municipality will not file eviction proceedings against all tenants. Consequently, a deadline of March 31, 2026 is set for the dismantling of the buildings. It is noteworthy that 15 tenants have already voluntarily dismantled their buildings. Although the Cottbus Regional Court's ruling is not yet final, tenants have the opportunity to file a non-admission complaint with the Federal Court of Justice, whereby the appeal value for an appeal is 20,000 euros - a sum that is unlikely to be reached in the current cases.
