Fight for Compact: Court decides on the impending ban!
On June 10, 2025, the main proceedings for a ban on the Compact magazine, which is in the focus of the Federal Ministry of the Interior, begin. This plans a ban on the magazine classified as a right -wing extremist, which is directed against the constitutional order. A first attempt to enforce this ban already failed in July 2024. Now the decision is located at the Federal Administrative Court, which could possibly come to a judgment this week. The Federal Administrative Court had already partially successfully successfully successfully released the magazine in August 2024.
The constitutional lawyer Prof. Ulrich Vosgerau, who acts as a legal advisor to the Compact magazine, commented on the developments and described the result of the urgent procedure as a provisional victory for compact, but not for the Basic Law. He emphasized that there could be no preventive media ban in the Basic Law and that a media law ban must be created by the state legislator, not by the federal legislator. The court questioned whether Compact-Magazin GmbH should be classified as a association within the meaning of the Association Act and whether the evidence of the protection of the constitution was sufficient for a ban on associations.
Constitutional protection is the focus
Compact-Magazin GmbH, which is headed by Jürgen Elsässer, is classified by the Federal Office for the Office for the Protection of the Constitution as constitutional. The GmbH is criticized because it supposedly spreads anti -Semitic, racist, anti -minority and history revisionist content. According to the ministry, the content is an aggressive-fighting approach that threatens the constitutional order. There are already indications of potential violations of human dignity in individual texts, but it remains unclear whether these facts can legitimize a ban.
The Federal Administrative Court had pointed out as part of the rush decision that the interest of Compact to suspend the ban, weighs more heavily than the public interest in immediate enforcement. However, it was also recognized that the court only had access to a small part of the publications and that further knowledge could be obtained from seized assets. This leaves space for speculation about the final outcome of the procedure.
the right -wing extremist context
The COMPACT case is not isolated. Other right -wing extremist organizations have also been banned in the past, including "Combat 18 Germany" and the "White Wolves Terrorcrew". These developments illustrate the authorities' efforts to take action against right -wing extremists and their public presentation. Such organizations often show their attitudes through specific characters and symbols, which are punishable and are associated with legal foundations such as §§ 86, 86a of the Criminal Code.
The upcoming negotiation day at the Federal Administrative Court, temporarily scheduled to Tuesday, could be the directional for the future handling of right -wing extremists in Germany. It remains to be seen whether there will be a ban, but is considered crucial for the debate about freedom of expression and the protection of the constitutional order.
