Things are getting serious in Mecklenburg-Western Pomerania: A new change in the law will regulate how wind turbines can be built near residential areas. From now on, both new wind farms and replacement systems, also known as repowering, must maintain a distance of at least 1,000 meters from closed settlements and 800 meters from fragmented settlements. This regulation, which was introduced in the state parliament by the government factions of the SPD and the Left, is primarily intended to help eliminate uncertainty among the population and increase acceptance of the expansion of wind power. Economics Minister Wolfgang Blank emphasizes that the success of wind power is only possible with local support.

But not everyone agrees with the new distance regulations. Criticism comes from the opposition. Petra Federau from the AfD fundamentally rejects the energy transition, while Wolfgang Waldmüller from the CDU even calls for larger distances, similar to those that apply in Bavaria. Hannes Damm from the Greens expresses concerns that these measures could represent an infringement on municipal rights.

Current developments in the wind power sector

The new change in the law follows the background that Mecklenburg-Western Pomerania already makes a respectable contribution to the German total of 5.9 percent with 1,853 wind turbines and a total output of 3,852 megawatts. However, the approval process in Mecklenburg-Western Pomerania is at the top of the state comparison list at 45 months, while the national average is only 18 months. In the first six months of the year, 417 megawatts were newly approved, which is in the middle range compared to other federal states.

Another important aspect of the change in the law concerns the repowering of wind turbines. In the future, the deadline for building a new facility after dismantling the old one will be extended from 24 to 48 months. In addition, the distance between the locations of the existing and new turbines was increased from twice to five times the total height of the new wind turbines. This means that the dismantling of old systems now has more comprehensive requirements.

As an additional relief, the approval process for repowering is optimized through a delta check that focuses on adverse effects compared to the current state. It is now even possible for a modernized system to be approved even if it does not meet all current emission control requirements. As long as sound pollution improves, repowering is still possible.

A look into the future

The aim of the legal changes is to promote renewable energies and at the same time reduce bureaucratic hurdles. But implementation remains a challenge. The pressure on municipalities and political actors is increasing as the population increasingly talks about the advantages and disadvantages of wind power. Against this background, it remains to be seen how public opinion will develop and whether the new distance regulations can actually lead to greater acceptance.

A good hand is required when it comes to reconciling the expansion of wind power with the fears of local residents. The coming months will show to what extent these legal changes will stimulate or even slow down wind power projects.
