Rollator accident in Hohen Neuendorf: trial ends with a fine!
A current trial at the Neuruppin regional court dealt with the fate of a 28-year-old who was convicted of negligent homicide. The presiding judge Jörn Kattenstroth led the appeal process after the young woman was sentenced to a fine of 4,500 euros by the Oranienburg district court in November 2022. The defendant appealed the verdict and wanted to challenge the decision.
The incident that led to this trial occurred on September 26, 2022, when the woman, while turning, ran over a 77-year-old who was crossing the street with a walker. According to reports, the driver only looked to the left when turning and did not notice the pedestrian. She was seriously injured in the accident and ultimately had to move to a nursing home. Tragically, she died on April 19, 2023 from pneumonia, which was believed to be a long-term consequence of the accident.
Legal situation on the subject of negligent homicide
Negligent homicide is defined in German law according to Section 222 of the Criminal Code and is often relevant in road traffic. This crime occurs when a road user causes the death of a person without the intent to kill by failing to exercise due care. The offense ranges from fines to prison sentences of up to five years. Such a killing can also occur through simple disregard of traffic rules, which played a role in this case. Offenses such as negligent homicide can lead to the revocation of a driver's license and have far-reaching consequences for those affected.
In the present case, the public prosecutor initially withdrew an application for a criminal order for negligent bodily harm after the accident victim died. The defendant did not have the opportunity to respond to the original penalty order. Before the court, Judge Kattenstroth expressed concerns that a new main trial would place an additional burden on everyone involved.
Procedure discontinued
Ultimately, the public prosecutor's office and the defense agreed to temporarily stop the proceedings in return for a payment of 900 euros to the German air rescue service. In addition to this payment, the defendant must also bear her own costs and those of the co-plaintiff. The responsible representative of the co-plaintiff expressed concerns about the defendant's access to the case and the associated legal steps. With this agreement, the proceedings were legally ended, which should be a relief for everyone involved.
Such a case impressively demonstrates the tragedy that can result from traffic accidents and the complex legal framework that exists in connection with negligent homicide. The negotiations not only have an impact on the perpetrator, but also on the victim's survivors, who have to live with the loss.
