Partial success for AfD: Court prohibits left -wing insulting statements!

In a heated legal dispute between the AfD and the Left District Association in Rostock, there is news: The district court Rostock has decided that the district association must not describe the two AfD MPs Thore Stein and Enrico Schult as "political and human assholes". This judgment is a partial success for the AfD MPs, who were drawn in court with their complaint against the allegations by the left-wing MP Dirk Bruhn. Süddeutsche Zeitung reports that the insults do not were justified as admissible expression in the context of the political argument.

The dispute has its origin in a heated debate in the state parliament. On April 10, Bruhn accused the two AfD MPs that they had made fun of the symptoms of his Parkinson's disease. His words caused excitement and led to an order call by the Landtag President Birgit Hesse. Despite the violent allegations, Bruhn could not penetrate the Schwerin district court with his complaint against the AfD MPs, since his presentation was not confirmed. The Schult and Stein then decided to take legal action against the repeated insults by the left-wing district association.

Legal examination continues

The Rostock district court has now decided that the blatant insult does not exceed the framework of the permitted, which the AfD parliamentarians consider as a positive step. According to Welt, the negotiation took more than an hour and a half. In this context, the presiding judge also questioned the authority of individual AfD MPs. Some allegations touched the parliamentary group as a whole and were therefore not only reserved for individuals.

It remains to be seen how the further legal steps will go out. The allegations and the associated lawsuits are negotiated in several legal proceedings. In the coming days, the Stralsund district court will also deal with an AfD injunction against the Linken-Kreisverband Vorpommern-Rügen.

The limits of expression of opinion

In the political argument, the limit between permissible criticism and punishable insult is often fluid. According to Section 185 of the Criminal Code, the insult protects the honor of a person and therefore differentiates between sharp and hurtful expressions of opinion. An extensive analysis of the law firm Mandic shows that particularly critical handling of statements can be observed in political discourse. A balance between freedom of expression and the protection against insults must constantly weigh the dishes.

In the case of the AfD parliamentarians, the outcome could be crucial to determine where the limits of political communication are. In the event of a violation of the latest judgment, the Left-wing district association threatens sensitive fines or even prison sentence of up to six months. The legal situation remains exciting and is observed closely by many political observers.
