The officers found the drunken man in the afternoon. Not only was he very drunk, but he also immediately confessed to the theft. However, the stolen bottles remained untraceable. The high alcohol level is not without its consequences, because from 3.5 per mille there is a danger to life, as the Federal Institute for Public Health warns. But what does that mean for the 35-year-old? According to the German Criminal Code, more precisely Section 242 of the Criminal Code, theft is the “unlawful taking of someone else’s movable property with the intention of unlawfully appropriating it for oneself or a third party,” explains lawyer Erhard’s website. In this context, the man would clearly have been in the wrong because he wanted to unlawfully take possession of the property of a third party.
The penalties are flexible and depend on the value of the stolen goods and other factors. Since in this case the value of the vodka bottles was probably less than 50 euros, there could theoretically be a mild penalty or even a dismissal of the proceedings due to insignificance. Finally, there are even options such as a penalty notice for lesser offenses, so the entire incident could end without a lengthy court process.

In the case of the Gifhorn man, however, there is another aspect: he already had an arrest warrant from the Hildesheim public prosecutor's office because of an unpaid fine in connection with fraud. This incident clearly shows why it is important to have a good handle on alcohol and to know the limits. The link between alcohol and criminal behavior often leads to a downward spiral that is stressful not only for the person affected, but also for society.
