legal background

The legal situation regarding cannabis has changed through the new Consumer Cannabis Act (Kcang). As lawyer Lott , the unauthorized trading with cannabis remains punishable, even if the new regulations can partially mitigate the deli. The law stipulates that trading in cannabis is punished differently under certain conditions, whereby lower amounts could be pursued less strictly.

The decision of the Federal Court of Justice of October 29, 2024 initiates a change by allowing the Kcang to be used under certain circumstances if this is advantageous for the accused. Nevertheless, the unauthorized activity remains a criminal offense, and the punishment can vary.

Current developments and consumption behavior

The legal changes are supported by a current statista evaluation. According to Statista , the legal cannabis market in Germany has grown to 1.2 billion euros in 2024. Cannabis consumption has increased in the population, and according to studies, almost one in three adults in Germany has now consumed cannabis.

The market for medical cannabis has also been growing since medical prescriptions are allowed in 2017. Nevertheless, a controlled delivery of cannabis to adults and the decriminalization of possession of small quantities could bring further changes in consumption behavior from April 2024.

Although the legal situation changes, the persecution of unauthorized trade remains a challenge for the judiciary. It is to be seen how the current procedures such as Paul I.
