New legal regulation for general meetings

The preparation of this general meeting coincides with the innovations that emerged from the Bundestag's draft law. On February 9, 2023, a change in the law was passed that allows clubs to hold hybrid and virtual general meetings. This now happens even without any special statutory provisions. Previously it was only possible if the statutes provided for this or all members agreed in writing. Before the pandemic, attendance was mandatory during general meetings unless corresponding regulations were included in the statutes. Haufe explains that The new guidelines make participation in club meetings much easier thanks to digital means of communication, such as video conferences or chat votes.

This new regulation, which came into force on March 21, 2023, not only promotes digitalization, but also brings with it the necessary flexibility, which is of great importance for many clubs today. Members can now choose whether they want to attend the meeting physically or virtually. Purely virtual meetings are also permitted, with participation taking place entirely electronically.

The event in Magdeburg shows how clubs can use the new opportunities to actively and flexibly involve their members. This brings more dynamism to communications and decisions within the club.
