The Waldheim JVA can breathe a sigh of relief: After a 28-year-old prisoner attempted to escape, director Martin Lindner expressed relief that there were no further incidents. “Escape attempts are indeed rare in correctional facilities,” says Lindner, who points out that the last successful escape in Saxony was several years ago. Although low-threshold attempts do occur from time to time, such as sawing on bars, the safety measures seem to be effective for the most part.
It is interesting that an attempt to escape is not a criminal offense according to the German criminal code. Nevertheless, the prisoner must expect consequences. In Saxony, 40 prisoners were released early so that they could spend the Christmas season with their relatives. This represents the second Christmas amnesty since 2020 and proves a change, as Saxony was previously an exception in this regard. Criminals who have to serve less than two years in prison or fines are particularly affected.
The spokeswoman for the Ministry of Justice emphasizes that this is not a “Christmas amnesty in the literal sense,” but rather an act of charity. The detainees who received amnesty were last able to gain their freedom in mid-November - including 39 adults and one juvenile. Other prisoners can also be released early under certain conditions until January 5, 2024. There are strict requirements: the prisoners must have medical care and be financially secure.
Conditions for early release from prison
Early release is a complex process. In Germany, convicted criminals must serve their sentence in a correctional facility. However, there are two main variants of early release: the two-thirds sentence and the half sentence. The latter is usually only possible for first-time offenders and with sentences of a maximum of two years. According to Section 57 of the Criminal Code, dismissal can be requested if special circumstances exist.
The application for early release must be submitted in writing to the responsible court and it is often helpful to provide evidence of good criminal records, a permanent address and regular work. If the decision is positive, the remaining sentence is often converted into a suspended sentence, which is subject to conditions. However, violations of these requirements can quickly lead to further imprisonment.
