Illegal: Court condemns police for speaking to students in a dangerous manner
The debate about right-wing extremism in Germany is being given new fuel by a current case in Ribnitz-Damgarten. This is 16-year-old Loretta B., who hit the headlines in spring 2024 due to suspected right-wing extremist content on her TikTok account. An anonymous tipster from North Rhine-Westphalia had informed the school about the content in question, which led to the police ordering a threat to Loretta and taking her out of class. However, this has now been deemed unlawful and disproportionate by the Greifswald Administrative Court. According to the court, the conversation could have taken place in a less stigmatizing setting, such as at home or at the police station. This is reported by the Uckermark Kurier, which has followed the development of the case in detail.
Loretta's family's lawsuit against the state of Mecklenburg-Western Pomerania and the Ministry of the Interior shows how serious the situation is. While the police did not classify the information obtained as criminally relevant, they still had a conversation with the student. The attempt to take preventive action against right-wing extremist activity was criticized by the court as inappropriate. Finally, the judge pointed out that more lenient procedures would have been possible in the sense of proportionality. At this point the question arises: How far can protection against extremist tendencies go?
Policy statement
Political reactions were not long in coming. Enrico Schult, a member of the AfD state parliament, was in court as an observer and expressed his support for the family. He demanded an apology from the ministers responsible, which caused additional discussions in political circles. In this situation, it is interesting to see that the left-wing politician Michael Noetzel recognizes the state government's efforts against right-wing extremist activities, but respects the court's ruling.
The Federal Agency for Civic Education is taking a deeper look at the problem. According to their information, an alarming increase in right-wing extremist violence and an increase in such crimes can be observed in Germany. In 2020, for example, over 23,000 right-wing extremist crimes were registered, including violent attacks. Particularly worrying are the cases of radicalization on the Internet, such as those of Tobias R. and Stephan B., which serve as examples of the worsening situation. The Federal Minister of the Interior recently described right-wing extremism as the greatest threat to security in Germany.
What remains to be done now?
The case of Loretta B. is both a symptomatic example of the existing social tensions and a wake-up call to address right-wing extremist tendencies. The line between prevention and disproportionate response is often thin, and school authorities in particular face the challenge of responding appropriately to such incidents. It remains to be seen what the future legal battles brought by Loretta's family will turn out to be.
The issue affects us all, especially at a time when right-wing extremist ideologies are once again experiencing a boom. It remains to be hoped that such preventive measures will be more closely aligned with the principle of proportionality in order to both protect the rights of individuals and protect the general public.
